1. What This Agreement Covers
These Terms of Service ("Terms") govern your use of Trustbourne, a digital vault service that stores encrypted files and releases them to people you trust when you become unresponsive.
Trustbourne is a division of Kiwazo CommV, a Belgian company registered in the Crossroads Bank for Enterprises (BE-0671852484).
By creating an account, you agree to these Terms. If you don't agree, don't use the service.
You must be at least 18 years old to use Trustbourne.
2. How the Service Works
Trustbourne provides:
- Encrypted storage for files you upload
- Trusted contacts who can receive your files
- Regular check-ins to confirm you're still responsive
- Automatic release of your vault to contacts if you stop responding
The service is designed for situations where you can't respond—whether temporary or permanent. We don't ask why. We just follow the process you've configured.
3. Your Account
What you agree to do
- Provide accurate information when registering
- Keep your login credentials secure
- Enable and maintain two-factor authentication
- Respond to check-ins (or pause them when needed)
- Keep your own contact information (email, phone) up to date
- Keep your contacts' information up to date
- Ensure your contacts have agreed to be listed
What you acknowledge
- If you fail to respond to check-ins, your vault will be released to your contacts
- We rely on the contact information you provide—if it's wrong, releases may fail
- You're responsible for configuring your check-in schedule appropriately
4. Your Vault and Files
Ownership
Your files remain yours. We claim no intellectual property rights over anything you upload.
Encryption modes
Trustbourne offers two encryption options:
Standard Protection We hold a release key for your vault. This enables automatic release to your contacts. We have technical capability to decrypt your files, but we don't—access is controlled by policy and audit logging. Decryption always happens in the browser, never on our servers.
Maximum Privacy (Zero-Knowledge) Only you hold the decryption key. We cannot decrypt your files under any circumstances—file names are encrypted too. Your contacts will need a passphrase you've shared with them separately (in a letter, with a solicitor, etc.). You can leave a personal message for your contacts (which might hint at where to find the passphrase); this message is stored encrypted with a key we manage, so we can display it to contacts after release. If you lose your passphrase, your files are permanently inaccessible. This is by design, not a defect.
What we can and can't see
Your files are encrypted before they leave your browser. We never see or store unencrypted file content.
In Standard Protection mode: We can see file metadata (file names, file sizes, folder names). This metadata is visible to us and will be visible to your contacts when your vault is released.
In Maximum Privacy mode: File names and folder names are also encrypted—we cannot see them. We can only see file sizes and the number of files. Your contacts will only see this metadata after they decrypt the vault with your passphrase.
We do not perform virus scans or content moderation on your files, and we won't. You are responsible for ensuring your files are safe. Your contacts should be aware that files they receive have not been scanned by us.
Your content responsibilities
You warrant that your vault doesn't contain anything illegal under Belgian or EU law. If we receive a valid legal order regarding your vault, we may be required to act.
5. Trusted Contacts
Your responsibilities
When you add someone as a contact, you warrant that:
- You have their permission to share their contact information with us
- You've told them they may receive access to your vault
- You have the right to share your vault's contents with them
- You will keep their contact information up to date
How contacts work
- Contacts verify their identity through email and phone confirmation
- They don't create accounts or passwords
- They can decline to receive your vault when offered
- Access to released vaults expires after 90 days
6. Check-Ins and Vault Release
The check-in process
We send check-ins through your chosen channels (email, SMS, WhatsApp). You respond by clicking a link, tapping a button, or logging into your dashboard.
If you don't respond:
- Days 1-7: We send reminders across all channels
- Days 8-30: We contact your trusted contacts to verify your situation
- Day 38: We send a final warning
- Day 40+: Your vault is released to your contacts
Exact timelines depend on your check-in interval.
Critical acknowledgment
If you fail to respond to check-ins for any reason—vacation, illness, lost phone, ignored emails—your vault will eventually be released.
This is the core function of the service. We cannot be held liable for vault release when you failed to respond to check-ins.
We're also not liable if check-ins don't reach you due to:
- Email delivery issues (spam filters, full inboxes)
- Phone number changes
- Messaging service outages
- Any other delivery failure
Use multiple channels. Keep your contact information current.
Inheritance and legal matters
Trustbourne is a file transfer service, not a legal or estate planning tool. We don't provide advice on inheritance law, wills, or estate regulations.
You and your contacts are responsible for ensuring that the transfer of your vault contents complies with applicable inheritance laws and regulations in your jurisdiction. We are not liable for any legal issues arising from the transfer of your files to your contacts.
7. Payment
Subscription
- Trustbourne is a paid annual subscription
- Subscriptions automatically renew each year
- You can cancel anytime from your account settings
- Prices are listed on our website and may change with 60 days notice
- New users get a 14-day free trial (no credit card required)
- Paid subscriptions include a 30-day money-back guarantee
If you don't pay
If your subscription lapses:
- Your account becomes read-only
- Check-ins are paused (your vault won't be released)
- Your files remain stored but you can't add new ones
- Renew anytime to restore full access
If you don't renew for 6 months, we may delete your account and files after giving you 30 days notice.
8. Ending This Agreement
If you want to leave
You can delete your account anytime from Settings. Deletion is:
- Immediate and permanent
- Destroys all your files and data
- Cannot be undone
We don't provide refunds for unused subscription time.
If we need to end your account
We may terminate your account:
- For violating applicable law or these Terms
- For non-payment (after the grace period above)
- When required by a valid order from a court or regulatory authority
Where possible, we'll give you notice and time to export your files. In cases of serious violation or legal requirement, we may act immediately.
9. Liability
What we promise
We will make reasonable efforts to:
- Keep the service available
- Deliver check-ins through your chosen channels
- Release your vault according to the escalation process
- Store your files securely in EU data centres
- Regularly review and update our security measures
What we don't promise
The service is provided "as is." We don't guarantee:
- Uninterrupted service
- Error-free operation
- That check-ins will always reach you
- That releases will always succeed
Limitation of liability
To the maximum extent permitted by law:
- We're not liable for vault releases resulting from missed check-ins
- We're not liable for failed releases due to technical issues
- We're not liable for what contacts do with released files
- We're not liable for content in your vault
- Our total liability is limited to fees you've paid in the prior 12 months
Your responsibility
You agree to indemnify us against claims arising from:
- Content you store in your vault
- Your contacts' actions after release
- Your violation of these Terms
- Your use of the service
10. Service Changes
Updates to the service
We may change features, add capabilities, or modify the service. For material changes, we'll give you 30 days notice.
If we shut down
If we decide to discontinue Trustbourne, we will:
- Give at least 12 months notice where possible
- Export your vault to you
- Notify your contacts
- Provide tools for local decryption
- Refund unused subscription time
11. Legal Details
Governing law
These Terms are governed by Belgian law. EU consumer protection regulations apply.
Disputes
If you have a complaint:
- Contact us at legal@trustbourne.com
- We'll try to resolve it informally within 30 days
- If unresolved, Belgian courts have exclusive jurisdiction
Assignment
We may transfer our rights under these Terms (for example, if we're acquired). You may not transfer your account without our consent.
Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
Entire agreement
These Terms, plus our Privacy Policy, constitute the entire agreement between us.
12. Changes to These Terms
We may update these Terms. For material changes, we'll:
- Give 30 days notice via email
- Highlight what's changed
- Let you export your data and close your account if you disagree
Continued use after the notice period means you accept the new Terms.
